Terms and Conditions

The following relates to the purchase of items through the Big Brand Beds shopping cart

  1. Validity
    These terms and conditions of sale govern the sale and supply of goods by Big Brand Beds. Big Brand Beds may amend these terms and conditions from time to time.
  2. Big Brand Beds Contract With You
    A contract exists between you and Big Brand Beds as soon as your order is received. Big Brand Beds is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods or for unavailability.
  3. Pricing and Availability
    All prices are subject to market fluctuations and revisions and the actual price paid by you shall be Big Brand Beds price ruling at date of dispatch. Such information is subject to change without notice. Where applicable, each price is inclusive of VAT (at the standard UK rate). There may be an additional charge for delivery. In the event that the goods are unavailable, or temporarily out of stock, or that Big Brand Beds needs to vary the price due to supplier price increases, or errors for example, following receipt of your order Big Brand Beds shall send you a notification by email or telephone and allow you the opportunity to cancel your order if Big Brand Beds has not done so itself.
  4. Payment
    Credit Card: We accept Visa, MasterCard, Switch, and Delta. Orders will be dispatched after payment.
  5. Delivery of Goods
    Big Brand Beds shall deliver the goods ordered to the delivery address, which you supply. When goods are delivered by a 2 man team we will where possible deliver to the room of your choice. However in the event of limited or restricted access (for which our drivers or agents will be the judge), we will deliver to the front door. If the customer then requests that we try to make the delivery inside the premises, we will ask that a disclaimer form is signed to negate us of any liability for accidental damage caused to the customers property whilst trying to make the delivery. In some cases we use a suppliers carrier which is a one man service. In this case the goods will be delivered to the door. In the event of a delivery date changing or a delivery is not completed on the given day, we will not be held liable for any costs incurred by the customer. All our deliveries are operated by third parties and we do not have ultimate control over their routing and time tables. Delivery time will generally vary between five and thirty working days, depending on the product ordered. Title to the goods will pass to you at the time of dispatch. Risk will pass to you on delivery.
  6. Big Brand Beds Guarantee and Returns Policy
    If you experience any problems with your new product, please email our Customer Service team or telephone us on 01273 857388 anytime between 10.00am – 4.30pm Monday to Saturday.

    Damaged items must be reported as soon as is reasonable after the delivery, preferably within 24hrs of receipt of goods.

    In the case of goods wrongly ordered or unwanted goods, they are returned at the customer's own cost. We reserve the right to charge for the collection of these goods which is typically £42.00. Goods must be returned in the original packaging or suitably wrapped so as to avoid damage and marking. They must have been unused and returned in perfect condition. depending on the supplier, there may be a restocking charge of up to 20% of the selling price of the goods.

    Filled Products - For reasons of health and hygiene we are unable to give refunds or credits on continental quilts, pillows and mattress toppers that have been opened unless they are faulty.

    Beds & Mattresses - For reasons of health and hygiene we are unable to give refunds or credits on beds and mattresses that have been opened unless they are faulty.
    Refunds or exchanges can only be given on production of a valid receipt

    Your statutory rights are not affected
  7. Exceptions to the right to cancel
    Customers should note that under Section 13 1 c of the Consumer Protection (Distance Selling) Regulations 2000, they do not have the right to cancel beds that have been specially ordered to their specific specification.

    This applies to beds with multiple variants, where the bed has been manufactured specifically for the customer. For example where there is a choice of mattress spring tensions and divan base fabrics. This ruling will generally apply to Adjustable beds, Relyon beds, Sealy beds and Staples beds.

    It is for this reason that each bed or mattress specifically ordered to the customer’s specification is not available from stock and is made to order, hence the general lead time of 4-5 weeks.

    Exceptions to the right to cancel
    13.—(1) Unless the parties have agreed otherwise, the consumer will not have the right to cancel the contract by giving notice of cancellation pursuant to regulation 10 in respect of contracts—
    (c) for the supply of goods made to the consumer’s specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly;

  8. Governing Law and Jurisdiction
    Contracts between you and Big Brand Beds shall be governed by English Law and all disputes shall be submitted to the non-exclusive jurisdiction of the English courts.
  9. Invalidity of Terms and Conditions
    If for any reason part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions shall not be affected.
